Art is a member of the Professional Liability Department where he concentrates his practice in professional malpractice and focuses primarily on the defense of claims made against government entities, real estate professionals, architects and engineers.  He has obtained favorable outcomes for his clients both at mediation and at every level of court in Delaware.

Prior to joining Marshall Dennehey, Art served as Delaware corporate counsel for a multi-state real estate title company.  He has conducted hundreds of Delaware real estate settlements and has successfully represented real estate professionals in a variety of matters.

Art's managerial experience gives him a unique perspective into the defense of professionals and directors and officers.  For instance, while in business school, he served as director of Global Lawyers & Physicians, a health and human rights non-profit organization based in Boston, where he expanded the organization's membership, raised funds and helped to lay the groundwork for creation of the Boston Refugee Center for Health and Human Rights.

Significant Representative Matters

  • Successfully defended, through briefing and oral argument, an out-of-state real estate settlement company in an appeal before the Delaware Supreme Court concerning allegations of consumer fraud and professional negligence.

  • Successfully argued dismissal of claims against the Board of Adjustment for a county government before the United States District Court for the District of Delaware in an appeal of the Board's denial of a variance application.

  • Successfully drafted a motion to dismiss claims of professional negligence before the Delaware Superior Court, on behalf of our client, an Arizona accounting firm.  Plaintiff’s response to our motion, on the grounds of Plaintiff’s own admissions, was to withdraw the complaint voluntarily without answering our motion.

  • Successfully argued summary judgment in favor of an architecture firm in a professional negligence matter before the Delaware Superior Court.

  • Successfully argued summary judgment in favor of a real estate broker before the Delaware Superior Court in an action for breach of a lease-to-buy contract.

  • Successfully argued summary judgment in a breach of contract action brought against our client, an insurance broker, for allegedly misrepresenting he could bind the insurance carrier.

  • Successfully represented an information technology company, in a matter before the Delaware Superior Court, against allegations of breaches of restrictive covenants.

  • Successfully defended a construction subcontractor before the Delaware Superior Court, against claims of negligence in paving a school driveway.  The claim was withdrawn upon our filing of a motion to dismiss.

  • Successfully argued dismissal of a Fair Debt Collection Practices matter against a collection agency before the United States District Court for the District of Delaware.

  • Successfully defended an insurance carrier’s denial of PIP benefits in an appeal before the Delaware Supreme Court, in Appellant’s attempt to apply the Kelty decision. 

  • Co-authored the winning briefs before the Delaware Superior Court, successfully arguing summary judgment for our client, an insurance carrier, in a declaratory judgment action regarding coverage for Plaintiff’s alleged work-related injuries.  

  • Co-authored the winning filings before the Delaware Supreme Court, successfully arguing lack of causation in a technically complex negligence/personal injury matter, securing affirmation of our summary judgment in the trial court below, on behalf of our client, a commercial manufacturer.  

  • Co-authored the winning filings before the Delaware Supreme Court, which affirmed our summary judgment in the Superior Court, regarding malpractice allegations against our client, a Delaware law firm.
