We obtained a defense verdict in a three-week birth injury trial. The plaintiff's economic loss included past medical expenses ($675,000), future wage loss ($2-3 million) and future care costs ($16-18 million present value, $48-$52 million adjusted for future increases per MCare Act). The defense offered an alternate damage scenario in the range of $3-6 million. The biggest challenge in the case, aside from the plight of the child, was that there was not a shred of documentary (or electronic audit trail) evidence that any nurse or doctor looked at the positive urine culture results before sending the patient home, although the defense contended that the result suggested a contaminated sample at a level which one would not treat.
