A summary judgment was obtained in a product liability case in which the plaintiff alleged that he was injured as a result of using a cold therapy unit, designed for post-surgical use to reduce pain and swelling. The plaintiff alleged that he suffered tissue or nerve damage because the unit provided too much cold. However, when he testified at deposition, he indicated that he really was no longer having much trouble in the area where he used the unit. The defense filed a motion for summary judgment on the basis of lack of admissable evidence as to medical causation, which was granted.
