Attorneys' persuaded the District Court of Appeals to affirm summary judgment entered on behalf of the defendant-owner and operator of a motocross track-on a claim that negligent maintenance and design of a jump on the track caused the plaintiff, an experience rider, to land his motorcycle off the track, producing a catastrophic brain injury.  This was the second appeal from a summary judgment in the case.  In the previous appeal, the District Court of Appeals reversed the summary judgment that had been entered for the defendant based on plaintiff's signing of a waiver of claims as a condition of being allowed to ride on the track.
