Attorneys obtained summary judgment on behalf of a community college. The college was sued by a former employee who claimed that she was subject to age discrimination and that her contract non-renewal was done in violation of the state Law Against Discrimination. Although the Plaintiff had been employed continuously for twenty-six years prior to the non-renewal of her contract, the defense attorney argued that the Plaintiff was not afforded the protections of the law because she was over seventy at the time that her contract was non-renewed and thus fell into an exception of the protections. After requesting the parties to submit supplemental briefs on this issue, the Court granted the motion in its entirety.
