Attorneys obtained the dismissal of a third party complaint against our client pursuant to a binding arbitration clause in the construction contracts. The third party plaintiff was a gym owner who recently had remodeled their facilities. Plaintiff alleged personal injury and permanency damages against the third party plaintiff after he sustained injuries in a fall in the remodeled locker room. Third party plaintiff then sought indemnification and contribution from our client, the project's general contractor. The contract between the parties, however, contained clear and unambiguous binding arbitration clause for any and all disputes "arising out of" the construction of the facility. After extensive discovery and motion practice, the judge agreed with our argument and entered an order dismissing our client from the case.
