Attorneys had all counts against their client, a home inspector, dismissed on preliminary objections. The judge dismissed the negligence, professional negligence and negligent misrepresentation claims against our clients based upon the "gist of the action" doctrine.  The judge also dismissed a breach of contract claim against our client for failure to plead a breach of duty owed by the contract.  The judge gave the plaintiffs permission to replead the breach of contract claim only.
