Attorney successfully persuaded Plaintiff, a prospective home buyer, to withdraw all claims he asserted against our client, his realtor, on the morning of trial. Plaintiff had alleged that his realtor failed to advise the home seller that he was unable to obtain a qualifying mortgage before the mortgage contingency deadline as set forth in the Agreement of Sale, thereby causing him to lose his deposit. The evidence, however, demonstrated that Plaintiff did not request that his realtor advise the seller of his inability to obtain a qualifying mortgage until after the deadline had passed. Moreover, there was evidence to suggest that Plaintiff merely wanted to back out of the agreement when he found out that renovations would be more costly than he anticipated.
