Attorney successfully had our client, a soils engineering company, dismissed from the matter on the state 10 year Statute of Repose. The soil company performed soil testing services during 1997 at a shopping center construction project. The services included testing the compaction of the soil behind a retaining wall that was being constructed. A section of the wall failed in 2007 and the entire wall had to be rebuilt. The plaintiff raised allegations of negligence by the soil company that contributed to the wall failure. However, our client was not sued until 2010 and the attorney moved to dismiss the claim as barred by the Statute of Repose and the court agreed, granting the motion.
