Attorney prevailed on a Motion for Sanctions, which resulted in the dismissal with prejudice of plaintiff's complaint and the imposition of an award of attorney's fees and costs. Plaintiff filed suit against two high school teachers and the high schooll's athletic director, alleging various claims under RICO and for defamation arising out of plaintiff's misguided efforts to promote his daughter's running career while she attended school in the district in 2001 and 2002. This was plaintiff's third lawsuit since 2004 premised upon the same set of facts and against the same parties, the most recent of which was dismissed on Preliminary Objections in July 2007. The Court concluded that because the claims here were nearly identical to those asserted in the two prior actions, the instant matter was meritless and brought for an improper purpose, thus warranting sanctions. The Court will conduct a hearing at the end of April to determine the amount of attorney's fees and costs for which plaintiff will be obligated to provide reimbursement.
