Attorney obtained summary judgment in a negligent security/premises liability claim. The plaintiff alleged that he was assaulted in our client's store by a third party and that the store was responsible for the assault because it failed to provide adequate security and failed to warn him of the possible dangers posed by the assailant. Our client moved for summary judgment based on the plaintiff's own deposition testimony (he had visited the store on many occasions and never observed dangerous activity by third parties and was unaware of the potential for danger on the day in question until the assailant touched him) and video surveillance which confirmed the store had no way to know the third party would assault the plaintiff. The court ruled that our client had no notice that the third party would harm the plaintiff and that there was no way for our client to have prevented the assault as a result
