Attorney obtained an order for summary judgment in a complex action filed against various Trustees and the Health and Welfare Fund. Defendants are the labor attorneys for the Union who were joined by the Union Trustees. Plaintiff alleged that the Union Fund held assets of Employee Welfare Benefit Plans within the meaning of ERISA §3(21)(A), 29 U.S.C. §1002(1). The court dismissed the claims against defendants, and defense attorney was able to establish that the attorneys did not participate in any fraud or misrepresentation. Once it was established that the attorneys represented the Fund within the degree of care expected of Fund counsel, the Summary Judgment Order was entered.
