Attorney obtained a dismissal of all claims against a law firm, brought under the Fair Debt Collection Practices Act. Plaintiff alleged fraud, and harassment because he received the summons for a foreclosure complaint addressed to, and intended for, his daughter and her husband. Using most of the attorney's arguments as reasoning, the district court granted a motion to dismiss, finding plaintiff had not stated a claim, as it was obvious the complaint was not directed to plaintiff.
