Attorney obtained a defense verdict in a jury trial on behalf of defendant camping organization. Defendant was sued by two railroad conductors/engineers who sustained serious injury when their train collided with a large tree which had fallen from the camping ground onto and across the railroad tracks. Plaintiffs alleged that the campground was negligent for failing to cull the large tree at the close of the camping season because it had shown signs of deterioration prior to the accident. The jury returned a verdict in favor of the Defendants finding no negligence after defense attorney successfully presented a number of witnesses as well as an abundance of evidence demonstrating that the Defendants did not breach their duty by properly inspecting trees and closing down the campground in October, two months prior to the December accident, and furthermore, illustrating that the Plaintiffs could not prove that any breach of duty by the Defendants was unreasonable or caused the collision between the train and the tree.
