Windsor v. United States, 133 S. Ct., 2884 (U.S., 2013)

Defense of Marriage Act is held unconstitutional.

The United States Supreme Court held that DOMA is unconstitutional as a deprivation of the equal liberty of persons, which is protected by the Fifth Amendment. DOMA defined “marriage” and “spouse” so as to exclude same-sex couples. By striking down the Act, the Supreme Court has allowed individual states to regulate marriage laws.
