Matt Keris, a shareholder in the Health Care Department in the firm's Scranton office, is speaking at the 13th Annual Medical Liability Insurance ExecuSummit. Nearly ten years after the call for the adoption of the electronic medical record (EMR), nearly every health care system has converted from hard copy paper records. As courts decide the issues, health care risk managers, claims professionals and defense counsel are beginning to emerge from the fog of uncertainty dealing with the novel clinical, preservation and production issues associated with the EMR. Matt will identify recent EMR cases of interest, with a special emphasis on issues involving the audit trail that may impact the standard of care in medical professional liability cases. Additional discussion topics will include EMR spoliation issues; new medical liability theories and arguments; use of expert witnesses in EMR litigation; and new peer review protection wrinkles.
