Janice Merrill and Chanel Mosley are presenting "EDs & EMRs & E-Discovery, Oh My! How to Stay on the 'Yellow Brick Road' When the Threat of Litigation Arises," at the FALA 2017 Annual Conference & Tradeshow. Their presentation will address how the implementation of electronic medical records (EMRs) systems in the health care setting, compounded by the use of electronic devices (EDs) for transmitting private health information has wreaked havoc on discovery requests in the health care litigation environment. Janice and Chanel will discuss how these electronic platforms and communication devices have affected the manner in which long-term care providers communicate with family members and physicians, as well as the importance of preserving that data and protecting its confidentiality to avoid a data breach. The presentation will additionally focus on how to respond to a plaintiff's discovery request when a lawsuit does occur, and the consequences of failing to preserve and produce electronic data, including the potential for an adverse inference or instruction at trial.
