Lynne Nahmani, a shareholder in the Health Care Department, is presenting a concurrent session at the 65th Annual AHCA/NCAL Annual Convention & Expo. "Sex and the Facility: Understanding and Reducing Liabilities" will address the rise of sexual abuse claims at assisted living and long-term care facilities, hospitals and other facilities for the aged or mentally challenged. Lynne will explore the types of claims in this spectrum that are typical to facility owners and the risk management measures that must be implemented to reduce liabilities. Inherent to the discussion will be the aging Baby Boomer population and increased sexual activity in assisted living and long-term care facilities as well as the capability of challenged individuals to consent to sexual activity. A case study featuring an actual incident and subsequent lawsuit that arose at a behavioral neuro developmental facility will highlight and illustrate the complexities of such litigation as well as legal defenses that may be employed.
