Rick has over 34 years of litigation experience primarily involving appeals, commercial litigation, employment litigation, insurance coverage, and insurance defense matters.

Immediately after law school Rick was associated with a firm which litigated matters primarily in the areas of general employment law, civil service, employment discrimination, constitutional law and civil rights, accidental disability pensions, and administrative law. He was then a partner in a firm specializing in directors and officers and professional liability insurance, both as counsel for insurers and as counsel appointed by insurers to defend insureds. Representation included litigation of insurance coverage disputes and bad faith claims. Substantive areas involved included securities act (10b-5 and related) claims, fraud, RICO, ERISA, derivative and class actions, wrongful discharge claims, Title VII and related discrimination claims, and claims involving governmental entities and non-profit corporations.

For 22 years prior to joining Marshall Dennehey, Rick was an associate and then principal of Jones Hirsch Connors Miller and Bull P.C.. He practiced primarily in the areas of appeals, insurance coverage, and insurance defense cases, handling a large number of matters involving third-party and first-party insurance claims, as well as appeals. He also represented insureds in a wide variety of bodily injury, property damage, and contract claims. His practice also included evaluation and defense of aviation insurance coverage cases and aviation liability claims.

Significant Representative Matters

  • Successfully represented the national parent corporation of a leading child mentoring organization against claims involving the abuse of a minor by a volunteer and alleged negligent supervision by the parent corporation and the local affiliate.

  • Successfully defended an engineer against claims of negligence and malpractice arising out of the pre-purchase inspection of a home.

  • Obtained the reversal of an appeal of a nearly $8 million verdict for bodily injuries resulting in an order directing a new trial on both liability and damages issues.

  • On appeal obtained the limitation of a property damage claim against an airline to $1,250, on the grounds that a limitation of liability clause was enforceable and other claims were preempted by the Airline Deregulation Act.

  • Defeated a bodily injury claim against the corporate affiliates of the plaintiff’s employer by successfully establishing that the employer’s workers’ compensation defense applied to all companies comprising “a single integrated entity.”

  • Obtained summary judgment dismissing a §1983 claim against an airport police force for alleged false arrest and malicious prosecution of a passenger whose luggage contained a firearm and successfully obtained an affirmance of that dismissal before the United States Court of Appeals for the Second Circuit in an appeal involving an issue of first impression concerning the interpretation and application of a federal statute immunizing the interstate transportation of firearms.
