Defective Drywall Litigation

Defective Drywall Litigation Practice Group

Marshall, Dennehey, Warner Coleman & Goggin has formed this Florida-based practice group in response to the significant emergence of claims and suits brought against condominium and homeowners' associations, developers, home builders, general contractors, subcontractors, manufacturers, and distributors/sellers of defective Chinese drywall.

According to some estimates, almost 600 million pounds of Chinese drywall have been imported to the United States since 2006, with almost half being used in Florida construction. It is, therefore, anticipated that the volume of litigation in situations where Chinese drywall is involved will be considerable. Preparation to defend against these claims is of paramount importance. The litigation brought against these entities assert entitlement to recovery for a wide variety of personal injuries and property damage allegedly attributable to exposure to defective drywall.

The members of our Defective Drywall Litigation Practice Group stand ready to provide vigorous defense against these claims, advancing challenges as to causal connection, extent of damage, and other forms of defense in order to defeat or, at the very least, limit recoveries in this emerging area of the law. The attorneys of this practice group constitute a group of professionals across the state of Florida who have considerable experience in construction defect law, product liability, class action, insurance coverage, condominium and homeowners' association, toxic and mass tort, real estate, and appellate law. Additionally, certain team members are also licensed to practice law in the states of Mississippi, Louisiana, and Michigan, and have been admitted to the federal appellate courts in these areas.

We welcome the opportunity to work with you in evaluating and defending your Chinese drywall matters, whether they be in the form of individual lawsuits in both first or third party claims or attempts for certification of class actions. We also stand ready to assist you with coverage disputes.
