Benjamin Nicolosi's practice covers a wide area of civil litigation, including motor vehicle, products liability, premises liability, dram shop/liquor liability, UIM defense, contract, bad faith, and legal malpractice. During the course of his career, Ben has handled several hundred automobile actions and tried cases in several separate federal and state court jurisdictions in northeastern Pennsylvania, including arguing before the Court of the Appeals for the Third Circuit.

With respect to recent litigation successes, Ben has resolved several underinsured motorist claims for substantially less than the expected payout. He successfully tried a products liability claim where the demand was $650,000 by prevailing on plaintiff's negligence claim. He successfully tried a motor vehicle case involving a claim for punitive damages for driving while intoxicated where the jury awarded no punitive damages. He obtained a defense verdict in a fear of AIDS case stemming from an infected epi-pen/needle. He has consistently resolved bad faith cases for less than the expected payout. Ben's clients include several national retail chains in premises liability, automobile liability, and products liability matters.

Ben received an MA degree in history and a BS degree in Political Science from the University of Scranton in 1990. He received his JD degree in 1993 from Catholic University's Columbus School of Law in Washington, D.C.

Following graduation, Ben began practicing law as a general practitioner. He later focused on personal injury litigation with a small plaintiff firm. In 1997 he joined MDWC&G's Casualty Department.

Ben is a member of the Lackawanna County Bar Association and the Pennsylvania Bar Association.
